Acceptance of Terms
By accessing or using the Fixrtech platform at fixrtech.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.
These Terms apply to all users — customers seeking tech support ("Customers") and IT professionals offering services ("Pros").
By creating an account, you confirm you are at least 18 years old and have the legal capacity to enter into a binding agreement.
The Platform
Fixrtech is a marketplace that connects Customers with independent IT professionals. Fixrtech LLC acts solely as a platform intermediary — we do not employ the IT professionals listed on our platform, and we do not provide tech support services directly.
IT professionals on Fixrtech are independent contractors, not employees, agents, or representatives of Fixrtech LLC. Fixrtech does not supervise, direct, or control the work performed by Pros.
Fixrtech makes no guarantee regarding the availability, quality, timeliness, or outcome of any service provided by a Pro on the platform.
Accounts
To use most features of the Platform, you must create an account. You agree to:
- Provide accurate, complete, and current information at registration
- Maintain the security of your password and account credentials
- Notify us immediately of any unauthorized access to your account
- Take responsibility for all activity that occurs under your account
- Not create more than one account per person without our consent
Fixrtech reserves the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.
For Customers
As a Customer, you may browse IT professionals, book sessions, and leave reviews. By booking a session, you agree to:
- Provide accurate information about the technical issue you need resolved
- Be available at the scheduled time and location for your session
- Grant the Pro reasonable access to devices and systems needed to complete the job
- Pay for the session in full upon booking
- Treat Pros with respect and professionalism
You acknowledge that Fixrtech is not responsible for any data loss, device damage, or security incidents arising from a Pro's work. We strongly recommend backing up your data before any support session.
For IT Professionals
As a Pro on Fixrtech, you are an independent contractor. By listing your services, you agree to:
- Provide accurate information about your qualifications, certifications, and experience
- Only accept bookings you are qualified and available to complete
- Arrive on time and conduct yourself professionally
- Maintain any licenses or certifications required to perform your listed services
- Comply with all applicable laws, including tax obligations as an independent contractor
- Not solicit Customers off-platform to circumvent Fixrtech's fees
Fixrtech reserves the right to remove Pro listings, withhold payouts, or terminate accounts for policy violations, customer complaints, or fraudulent activity.
Payments & Fees
All payments are processed securely through Stripe. By completing a booking, you authorize the charge to your selected payment method.
Platform Fee: Fixrtech charges a 15% commission on each completed booking, deducted from the total before the Pro receives their payout.
Payment capture: Payments are authorized at booking and captured upon session completion. If a session is not completed, the authorization is released and you will not be charged.
Refunds: To request a refund, contact support@fixrtech.com within 48 hours of your session. Refund eligibility is determined on a case-by-case basis. Fixrtech's decision on refunds is final.
Pro payouts: Pros receive their earnings via Stripe Connect after session completion. Payout timing is subject to Stripe's standard processing schedule.
Prohibited Conduct
The following are strictly prohibited on the Fixrtech platform:
- Providing false or misleading information in your profile, booking, or reviews
- Harassment, abuse, or threatening behavior toward any user
- Booking sessions with no intent to pay or complete
- Soliciting off-platform transactions to bypass Fixrtech fees
- Posting fraudulent or fake reviews
- Unauthorized access to Fixrtech systems or another user's account
- Using the platform to conduct illegal activities
- Scraping or automated data collection without permission
Violations may result in immediate account suspension, withholding of funds, and referral to law enforcement where applicable.
Intellectual Property
All content on the Fixrtech platform — including the logo, design, code, copy, and graphics — is the property of Fixrtech LLC and protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works without our express written permission.
By submitting content to the platform (such as reviews or profile information), you grant Fixrtech a non-exclusive, royalty-free license to display and use that content in connection with operating the platform.
Disputes Between Users
Fixrtech is not obligated to mediate disputes between Customers and Pros, but may do so at our discretion. Contact support@fixrtech.com and we will review the situation.
You agree to release Fixrtech LLC from any claims, demands, and damages arising from disputes with other users.
Disclaimers
The Fixrtech platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Fixrtech does not warrant that:
- The platform will be uninterrupted, error-free, or secure
- Any specific IT professional will be available or produce a satisfactory outcome
- Results from a support session will meet your expectations
- The platform is free from viruses or harmful components
Limitation of Liability
To the maximum extent permitted by law, Fixrtech LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or services rendered by Pros.
In no event shall Fixrtech's total liability to you exceed the greater of (a) the amount you paid to Fixrtech in the 12 months preceding the claim, or (b) $100.
Some jurisdictions do not allow limitations on implied warranties or liability for incidental damages, so the above limitations may not apply to you.
Termination
You may close your account at any time by contacting support@fixrtech.com. Upon termination, your right to use the platform ceases immediately.
Fixrtech reserves the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion. Provisions relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.
Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the platform shall be resolved exclusively in the state or federal courts located in Cook County, Illinois.
You waive any objection to jurisdiction or venue in those courts.
